| Can someone please enlighten me on whether the seller is responsible for any defects on completion of the sale for a limited Period ? I have heard this is the case from 2 people. One saying 2 years, and another person saying 6 months? |

Did you not have a survey done ? That would show up any defects, and usual carries a guarantee if a defect turns up thats not in the survey that should have been.
Under the current home buying process in England and Wales, the onus is on the buyer to commission a survey of the property and discover any defects or risks after his offer has been accepted.
After completion the buyer is responsible to insure the property from the date of exchange of contracts and to have the repairs carried out.
The buyer will then have to make a claim on their insurance policy. |

Hi Sarah
Thanks for your reply. No before we left the property we did not have a survey done. But the prospective buyer has had a survey done. The only thing that has come up from that surveyors report showed that there was no Firewall in between the two houses, as it is a semi detatched property.
Now Im Financing that, and the Builder has asked to have a Structual Engineer to check as there is a slight Problem before work is carried out. So Ive agreed on that.
The trouble is Sarah the buyer is a problem, and Ive reduced the property enough. I have notified my Solicitor no further reductions. Shes even checking the Guttering. Ive also spent money doing the property up? |

Okay, I now understand your selling the property.
Yes the usual procedure is that once you have accepted the offer, the buyer has a survey done, as all problems need to be resolved before exchange of contracts, after which the buyer cannot have any come back on you.
Yous solicitor should confirm this for you. |

2 Weeks ago the buyer had her Survey done, and as the place is a Semi - Detatched Victorian House it was found there wasnt a Firewall between the Properties! She said she would not get a Mortgage without one. She also stated that once it had been done she would have it Inspected by the Surveyor + the Guttering!
She is beginning to annoy me as she has a builder friend as I do, and she said she would use her builder, and have the money deducted! I insisted I keep my builder!
Now I have letters from Solicitors over Guttering which is ok! Phonecalls from Estate Agents as she is pushing them into when the work is going to be completed! She evidently is in a chain, and shes the cause of the trouble, as my builder and friends have said
What do you think - Im on a go slow!! |

I don't know much about property, whats a firewall between semi detached houses ? You mean to the other house not linked ?
Maybe shes working up to a price reduction ? |

No the semi - detatched which is coupled to mine, and the firewall is to be fitted in the loft. As you are aware properties nowdays have to have this, in victorian days it was unheard of!
Working up a price reduction huh, shes already had that . Now shes in a hurry because shes in a chain. She can find the money for loads of surveys, but cannot find any money to pay for a third of the costs!
She constantly phones the estate agents, and he tells me the buyers chinese and speaks little english. I said to the agent she can speak good english to the solicitors and bargain and be a right pain in the butt!!  |

Seems like it would be requirement for the mortgage to have a firewall. So the firewall needs to be in place, I think its reasonable to expect you to cover this cost, because its not something consmetic or that can be left for a later date. |
